How Do No Win No Fee Agreements Work in Scotland?
In Scotland, a No Win No Fee agreement means you only pay your solicitor if your claim is successful. Your solicitor must put all the terms in writing before you sign anything.
Do you pay upfront? No. Scottish law requires your legal provider to cover the day-to-day costs of running your case, like paying for medical reports and court fees.
Will fees come out of your compensation? Yes, but the law strictly limits how much they can take. If you win, the deduction is capped at 20% of the first £100,000, 10% of the next £400,000, and 2.5% on anything above that amount.
What happens if you lose? A Scottish legal rule known as QOCS protects you from having to pay the other side’s legal bills. You keep this protection as long as you play fair. You only lose it if you lie, behave in a manifestly unreasonable manner, abandon the case, or reject a formal settlement offer but end up getting less in court. You might also have legal cover on your home or car insurance to give you extra backup.
What Types of Personal Injury Claims Can You Make in Kilmarnock?
Not every accident leads to a valid claim. To have a case, there needs to be a duty of care, a breach of that duty and an injury that resulted from it. The following situations are among those we see most often across Kilmarnock, Stewarton, Galston, Ayr, Irvine and the wider Ayrshire area:
- Injury at work, including machinery accidents in local manufacturing hubs, falls from height, and manual handling injuries.
- Road traffic accident claims involving drivers, passengers, motorcyclists, cyclists and pedestrians, which frequently occur on busy local routes like the A77 corridor, the Bellfield Interchange, and the A71.
- Public liability claims for slips and trips in shops, car parks and on pavements.
- Industrial injuries and occupational illness, such as hearing loss, vibration white finger and asbestos-related conditions.
Road Traffic Accident Claims and Workplace Injuries
A road traffic accident may support a claim where another road user was at fault. Being in an accident is not enough on its own. The evidence around how it happened is what matters.
It is a similar story for workplace injuries. Your employer is required to protect you under the Health and Safety at Work Act 1974, and they have to hold the right insurance. To prove what went wrong and who was responsible, your solicitor will collect key evidence such as the accident book log, risk assessments, CCTV footage, and witness statements from your colleagues. Just like with road accidents, your medical records are a vital part of the claim.
Public Liability, Slip, Trip and Fall Claims
Under the Occupiers’ Liability (Scotland) Act 1960, anyone who controls premises has a duty to keep people reasonably safe. That applies to private landlords, retail shops in Kilmarnock town centre, and public spaces managed by East Ayrshire Council.
Uneven paving, poor lighting, unmarked spills and trailing cables are among the more common causes. That said, having a fall does not automatically mean the occupier is liable. You need to show the problem was there, that the occupier knew or should have known about it, and that it would have been found with reasonable care.
If you are involved in an accident, photograph the scene, note the time and weather, record any witness details and get medical attention even if you feel fine initially.

The Personal Injury Claims Process in Scotland
When you have been injured because of someone else’s negligence, knowing what to expect helps. We manage the legal strategy of your claim from start to finish, keeping you informed at every step while you focus on getting better.
- Initial assessment, where we review what happened and whether a claim is viable.
- Your solicitor starts gathering evidence such as CCTV, accident reports and witness details.
- A letter of claim is sent to the defender or their insurer.
- Getting a private medical report to understand the full impact of your injuries. Your solicitor will review your initial A&E or treatment notes from University Hospital Crosshouse or your local GP before arranging this private specialist assessment.
- Liability assessment, where the other side admits or disputes responsibility.
- Settlement negotiations, which is where most claims are resolved.
- Court proceedings at a local venue, such as Kilmarnock Sheriff Court on St Marnock Street, or the Court of Session, if an agreement cannot be reached out of court.
We can also help you claim for a child, or for a loved one who cannot make legal decisions for themselves. If your claim involves medical mistakes, keep in mind these cases usually take longer because they require in-depth reports from independent doctors.

Scottish Personal Injury Claim Time Limits and Compensation
Two main factors determine whether a claim can go ahead: proving that someone else was at fault, and ensuring you are still within the three-year legal deadline.
The Three-Year Limitation Period: When Does the Deadline Start?
Most personal injury claims in Scotland must be started within three years. That period usually begins on the date of the accident.
Where an injury or illness develops over time, the clock starts from the point when you knew, or reasonably should have known, that your condition was linked to someone else’s actions.
For children, the three years begin on their 16th birthday. Adults without legal capacity are treated differently. Courts can sometimes extend the deadline, but this is not something to rely on. If your accident was more than two years ago, get advice as soon as possible.
How Is Personal Injury Compensation Calculated in Scotland?
Compensation is composed of two main parts.
Solatium covers your physical pain, emotional distress, and changes to your daily lifestyle. Its value is calculated using official court guidelines and settlements from similar past cases.
Patrimonial loss covers the financial side, including lost income, care from family members, medical costs, travel to appointments and any future treatment needed.
FAQs
Can I Make a No Win No Fee Personal Injury Claim in Kilmarnock?
If someone else’s mistake or negligence caused your injury, you likely have a claim. You can usually fund your case on a No Win No Fee basis as long as you have solid proof and a good chance of winning.
What Happens If My No Win No Fee Claim Is Unsuccessful?
Your written agreement sets out what applies. QOCS protection generally means you will not face the other side’s legal costs if the case was conducted properly, though this can be lost in certain circumstances.
How Much Does a No Win No Fee Solicitor Charge in Scotland?
There is no fixed amount. The success fee is stated in your agreement and capped as described above. Ask for a written breakdown of what would be deducted from any award before you sign.
How Long Do I Have to Make a Personal Injury Claim in Scotland?
Three years from the date of injury or the date you became aware of it in most cases. Children have until three years after their 16th birthday. Confirm your specific deadline early, as the starting point can vary depending on the circumstances.
How Long Does a No Win No Fee Personal Injury Claim Take to Settle?
It depends on the case. Simpler claims where the other side accepts liability can settle within a few months. Where liability is disputed, or the injuries are serious, the process takes longer. Claims generally cannot be finalised until the medical position is clear, since compensation cannot be properly valued while recovery is still ongoing.
