How No Win No Fee Works Under Scottish Law
In Scotland, this arrangement is formally known as a Speculative Fee Agreement. Your solicitor’s fees are only payable if your claim succeeds. When it does, a success fee is deducted from the compensation you receive. For personal injury cases, that fee is strictly capped under the Civil Litigation (Expenses and Group Proceedings) (Scotland) Act 2018 at a maximum of 20% of your compensation (depending on the value and type of claim).
Read the terms carefully before you sign anything, and confirm that your solicitor is regulated by the Law Society of Scotland.
Success Fees, Outlays and What You Might Pay
The success fee is the amount deducted from your compensation if your claim wins. Outlays are separate. These are the third-party expenses required to build your case, such as fees for obtaining medical records, independent expert medical reports (typically ranging from £150 to £500+ depending on complexity) and official court lodging fees.
Under a Speculative Fee Agreement, these costs are usually deferred until after the claim. If you win, the other party pays them back. If your claim is unsuccessful, they are protected by After-the-Event (ATE) insurance, meaning you never pay for them out of pocket.
What QOCS Means If Your Claim Fails
If your claim does not succeed, will you have to pay the other side’s legal costs? In most cases, no. In eligible Scottish personal injury cases, Qualified One-Way Costs Shifting, known as QOCS, generally protects a pursuer (the person making the claim) from being ordered to pay the defender’s expenses.
QOCS is a court protection and sits separately from your funding agreement. Exceptions do exist where the court may remove QOCS protection, such as if a claim is found to be fraudulent or dishonest, if the pursuer acts in a manifestly unreasonable manner during proceedings, or if the case is abandoned without good reason.

Types of Claim We Assess in Alloa and Clackmannanshire
We assess claims from people across Clackmannanshire and the Forth Valley, including Alloa, Sauchie, Tullibody, Alva, Tillicoultry, Dollar, Menstrie, Clackmannan and Stirling. Whether a claim can proceed depends on the evidence available, the duty that applied in that situation and who was responsible.
Workplace Accident Claims in Alloa
Suffering an injury at work does not automatically make your employer liable. o make a claim, you need to show that your workplace cut corners on safety, and that this caused your injury.
That failure often involves poor training, broken equipment, missing PPE, or ignored safety rules under the Health and Safety at Work Act. For a claim to work, you have to show that poor workplace safety caused your injury.
Workplace accidents are widespread across Scotland. According to the HSE key facts for Scotland 2025, employers reported 5,686 non-fatal employee injuries in 2024/25 across factories, warehouses, retail, and construction.
Road Traffic Accident Claims in Alloa
Collisions happen along the A907 and A908 corridors and on the roads toward Dollar and Alva. Drivers, passengers, motorcyclists, cyclists and pedestrians can all potentially make a claim if the evidence supports one. Whiplash is among the more common injuries that result from road collisions.
Proving who caused a crash comes down to what the evidence shows. Helpful details include photos of the damage, dashcam clips, contact numbers from anyone who saw it happen, or a police reference number. If you were treated at Forth Valley Royal Hospital or checked over by your GP, those medical notes also play a big part in showing how the collision affected you.
Collisions like these are sadly widespread. According to Transport Scotland’s Key Reported Road Casualties Scotland 2025, 5,535 people were injured on Scottish roads in 2025, with nearly 2,000 seriously hurt.
If the other driver was uninsured or was never identified, the Motor Insurers’ Bureau may provide a separate route to compensation. Make sure to mention this when you contact us.
Slips, Trips and Falls in Alloa
A fall in a supermarket aisle, on a damaged pavement or in a poorly maintained car park can lead to a public liability claim if the person or organisation in control of that space failed their duty of care under the Occupiers’ Liability (Scotland) Act 1960.
If it is safe to do so, photograph the problem and report it promptly. Clackmannanshire Council is responsible for pavement defects on public roads. Note any witnesses and keep a record of your injuries and treatment.
One thing worth being clear on: the danger alone does not prove negligence. It also has to be shown that the problem was something that could and should have been prevented. That is the question we look at during your assessment.
How Liability Is Established
Every personal injury claim rests on the same core questions. Was a duty of care owed to you? Was that duty breached? Did the breach cause your injury? And can the resulting injury and financial losses be evidenced? We look at what you have, identify any gaps and advise on whether it is worth proceeding.
What Evidence Helps a Claim?
Start with whatever you have. Useful material includes:
- Medical records linking your injury to the accident
- Photographs of the scene or problem
- Accident book entries
- Witness contact details
- Payslips and receipts showing financial losses
If you do not have photos of the scene, do not worry. Missing pictures will not stop you from claiming. Details like CCTV footage, witness statements, and doctor notes can build a strong case. Hold on to whatever information you do have, and our team will review it during your assessment.

How Compensation Is Calculated in Scotland
Scottish personal injury compensation generally falls into two categories:
| Type | What It Covers | What Helps Evidence It |
|---|---|---|
| Solatium | Pain, suffering and loss of amenity, including psychological effects | Medical records, expert reports, prognosis evidence |
| Patrimonial Loss | Financial losses caused by the injury | Lost earnings, travel costs, care expenses, receipts and payslips |
How much you could receive depends on the severity of the injury, recovery time, long-term effects and the damages you can support with evidence. To give you an accurate valuation, our legal team takes the time to look closely at how the injury has impacted your daily life and finances.
What Happens After You Contact Us?
Here is a rough outline of how a claim typically progresses, though timing depends on the complexity of the case and how disputed liability turns out to be:
- Assessment: you describe the accident, and we look at whether a claim is viable
- Evidence gathering: records, witness statements and liability documents are gathered together
- Letter of Claim: issued to the other party under the Pre-Action Protocol for Personal Injury Claims in Scotland
- Medical evidence: an independent expert provides a report and prognosis
- Negotiation: most claims settle at this stage, sometimes after a formal Minute of Tender
- Court: raised only where fault or the value of the claim cannot otherwise be resolved
Most claims settle without ever reaching a hearing. Where proceedings are raised, many still settle before the case is heard.

Where court action is needed, smaller claims often go to Alloa Sheriff Court. Higher-value cases may be raised at the All-Scotland Sheriff Personal Injury Court in Edinburgh, which has national jurisdiction for personal injury matters.
Court is always a last resort. Many claims are resolved long before a hearing becomes necessary.

Time Limits for Personal Injury Claims in Scotland
You generally have three years from the date of the accident to raise a court action, under the Prescription and Limitation (Scotland) Act 1973. If you only became aware of the injury or its connection to another party at a later point, the three years may run from that date instead.
For children, the period generally starts at age 16. Where someone lacks legal capacity, different rules can apply.
Getting advice early keeps your options open while the evidence is still fresh. Contacting us does not stop or extend the clock.

Frequently Asked Questions
What will it cost if my claim does not succeed?
If your claim fails, your solicitor’s fee is generally not payable. What you might still owe depends on the agreement’s terms around outlays and insurance premiums, so ask for a written breakdown before signing. QOCS generally protects you from the other side’s costs, though exceptions do apply.
Will I need to attend Alloa Sheriff Court?
Not automatically. Most claims settle before a hearing. Court proceedings are only raised where fault or the value of the claim cannot be resolved another way, and many cases settle even after proceedings begin. If attendance looks likely at any stage, we will let you know early.
Can I make a claim on behalf of a family member?
In some circumstances, yes. A parent or guardian can claim on behalf of a child, while an authorised representative can act for an adult who lacks legal capacity to manage their own affairs. Fatal accident cases have their own separate rules about who is entitled to pursue a claim. Tell us the circumstances, and we can advise on the right approach.
