If you’ve been injured in an accident that wasn’t your fault, the last thing you should have to worry about is how to afford legal help. Whether your accident happened on the cobbled pavements of the Old Town, out on the City Bypass, or inside a Princes Street shop, we are here to help you figure out exactly who is responsible and what happens next.
A No Win No Fee agreement lets you pursue a personal injury claim in Edinburgh without upfront legal fees. If your claim succeeds, a previously agreed success fee comes from your compensation. If it fails, no fee is payable.
NWNF manages the legal strategy of your claim. We work alongside specialist personal injury solicitors suited to your case and keep you informed while you focus on recovery.

How Do No Win No Fee Agreements Work in Scotland?
Most No Win No Fee claims in Scotland don’t require any money upfront.
If you win your case, your lawyer takes a pre-agreed cut of your payout to cover their work. If you lose, you don’t owe them anything. Better yet, Scottish law generally protects you from having to pay the other side’s legal bills if the claim falls through.
Before you sign an agreement, it’s always worth checking your car, home, or bank insurance. Many of these everyday policies have legal cover already baked in.
How Does QOCS Protect You From Certain Legal Costs?
QOCS Scotland stands for Qualified One Way Cost Shifting. This means that in most personal injury cases, you will not have to pay the legal costs of the defender if your claim does not succeed.
This safety net isn’t an absolute guarantee. A judge can still make you pay the other side’s legal bills if you lie about your claim, act unreasonably, or reject a formal settlement offer and then win less money in court. If you’re worried about this, you can take out a specific type of insurance (known as After the Event insurance) to cover the cost.
Your No Win No Fee deal handles your own lawyer’s bills, while QOCS protects you from your opponent’s bills. Because every case is different, always ask your lawyer for a written breakdown of exactly what you are and aren’t protected against.
What Happens to Legal Fees and Success Fees If My Claim Succeeds or Fails?
When figuring out the cost of a claim, you’re usually looking at three different charges. There’s the bill for the lawyer’s actual work, the outside costs like medical reports or court fees, and finally the success fee, which is the cut taken from your payout if you win.
Scottish law caps success fee on a sliding scale (including VAT) to keep things fair:
- 20% on the first £100,000 you receive.
- 10% on the amount from £100,000 to £500,000.
- 2.5% on anything above that.
If you win the case, the losing side will usually step in to pay your lawyer’s basic legal bill. Your lawyer then just subtracts the success fee and any unpaid outside costs from the settlement before sending you the rest.
If you lose, that success fee is waived completely, meaning you owe the lawyer nothing for their time. Just bear in mind that you might still be on the hook for some of those outside costs, depending on what your contract says.

What Types of Personal Injury Claims Do We Handle?
Road Traffic Accident Claims
Road traffic accidents across Edinburgh and the Lothians affect everyone from drivers and motorcyclists to cyclists and pedestrians. According to Transport Scotland figures, 593 people were killed or injured in Edinburgh road collisions in 2025, with 149 of those injuries classed as serious.
Whether it’s a cyclist injured near Haymarket, a pedestrian struck on a city centre crossing, or a rear-end shunt on the City Bypass (A720), the claims process follows the same path. Ultimately, the insurer of the driver at fault is responsible for handling the claim.
If you are involved in a collision, you should always try to:
- Note the other vehicle’s registration number.
- Take photographs of the scene.
- Collect contact details from any witnesses.
- See your GP, even if your injuries feel minor.
It is important to act quickly, as local CCTV footage is frequently wiped within just 14 to 30 days.

Workplace Accident Claims
Accident at work claims depend on whether your employer met their duty of care. Inadequate training, defective equipment, and poor housekeeping are common causes of injuries across hospitality, retail, construction, and technology workplaces in Edinburgh.
You can claim while still employed because employers’ liability insurance exists for exactly this reason.
Proving that your employer is at fault comes down to solid evidence, so what you do right after the accident is crucial.
If you can, try to:
- Report the accident in the staff accident book immediately.
- Snap a quick photo of the problem before it gets cleaned up or fixed.
- Jot down the names of any coworkers who witnessed what happened.
Having these records from day one carries a lot of weight if you later decide to make a claim.
Slips, Trips, and Public Liability Claims
A fall on a loose cobblestone near the Royal Mile, a supermarket spillage, or an unlit step outside a pub can all give rise to a public liability claim if the occupier owed and breached a duty of care.
Simply falling down does not establish liability. A successful claim usually needs to show that the problem was known about or should have been known about. You must also prove that a reasonable inspection would have identified and removed the danger.
Make sure to photograph the exact spot, ask staff to log the accident, and gather witness names. Inspection and maintenance records ultimately decide the outcome of most of these cases.
How Is Personal Injury Compensation Calculated in Scotland?
| Category of Loss | What It Covers | How It Is Valued |
|---|---|---|
| Solatium | Compensates for pain, suffering, and loss of amenity (what the injury took away from you). | Valued by looking at past court decisions, supported by an independent medical assessment. |
| Patrimonial Loss | Covers the direct financial impact of the injury. | Includes loss of earnings, medical expenses, travel to appointments, adapted equipment, care costs, and damage to property. Serious injury claims involving brain or spinal trauma also account for future care needs. |

What Is the Personal Injury Claims Process in Edinburgh?
- Claim assessment: We review what happened and confirm whether there is a reasonable case to pursue.
- Evidence gathering: Your solicitor gathers the medical records, a GP report, photographs and witness statements.
- Claim intimation: The claim goes to the defender or their insurer under the pre-action protocol.
- Liability: They either make a liability admission or dispute liability, setting the tone for everything after.
- Medical evidence: An independent medical assessment confirms diagnosis, recovery period and lasting effects.
- Settlement: The vast majority of claims are successfully resolved through out-of-court negotiations long before a judge gets involved. Formal court proceedings are only ever used as a last resort if a fair agreement simply cannot be reached.
Where Are Edinburgh Personal Injury Claims Handled?
Most claims settle completely without a hearing. Where legal proceedings do become necessary, the financial value and complexity of the case determine the right court.
Because the Sheriffdom covers a wide area, an accident claim in Livingston, West Lothian, is typically handled alongside city cases at the Edinburgh Sheriff Court. Higher value cases may go to the All Scotland Sheriff Personal Injury Court, which sits in the exact same building. The most substantial and complex claims are dealt with in the Court of Session at Parliament House.

How Long Do I Have to Make a Personal Injury Claim in Scotland?
You generally have exactly three years from the date of the accident to make a claim. Alternatively, the three years can start from the date you first knew your injury was connected to the accident. The Prescription and Limitation (Scotland) Act 1973 sets this specific limitation period.
For children under 16, the three-year countdown is put on hold. The three-year period does not start until their 16th birthday, meaning they have until their 19th birthday to make a claim. Mental incapacity can also pause the calculation. Courts do have the power to extend the period where it is deemed equitable, although you can never rely on this being assured.
Time limits are strictly applied in Scotland. Therefore, it is always best to seek legal advice early on, even if your injuries currently feel manageable.
Frequently Asked Questions
Can I Make a No Win No Fee Personal Injury Claim in Edinburgh?
A valid claim requires three things. Firstly, someone must have owed you a duty of care. Secondly, they must have breached that duty. Finally, their breach must have caused a measurable injury. Having strong evidence and a meaningful injury gives you the best prospects of success. Eligibility can only be fully confirmed on a case-by-case basis.
What Evidence Do I Need for a Personal Injury Claim?
Items such as medical records, witness statements, photographs, an accident report, employment records, receipts, and proof of lost earnings all help build your case. No single document decides a case on its own.
Will My Edinburgh Personal Injury Claim Have to Go to Court?
Most claims settle through negotiation long before a hearing is ever required. Court proceedings only become necessary when liability is firmly denied or when the settlement offer is far below what the injury justifies. Your solicitor will tell you well in advance if a court hearing is likely.
